Which terms apply

If you obtained FlowVisual through the Mac App Store, Apple's Standard End User License Agreement applies. If you obtained it through the Microsoft Store, the Microsoft Store Terms of Sale apply in addition to the terms below. For a licence purchased directly from us, the terms below apply in full.

1. Licence

Balane GmbH grants you a non-exclusive, non-transferable right to install and use FlowVisual on the devices you personally use, for as long as your licence or subscription is valid. The free scope of the application may be used without a licence and without a time limit.

2. What is not permitted

• Passing on, sublicensing, renting or selling the software or a licence key to third parties.
• Decompiling, disassembling or reverse-engineering the software, except where mandatory law expressly permits it.
• Removing or altering copyright notices, licence checks or trade marks.

3. Your data and your documents

Everything you create with FlowVisual is yours. Models, exports and generated documents may be used commercially without restriction — including in proposals you sell to your own clients. We claim no rights to them and, as described in our privacy policy, we never receive them.

4. Subscription and term

FlowVisual Pro is a subscription. Where you bought it determines how it is billed and cancelled: through your Apple account, your Microsoft account, or directly with us. A subscription bought through a store renews automatically unless cancelled at least 24 hours before the end of the current period; you manage and cancel it in the account settings of that store, not here.

5. Warranty and liability

FlowVisual is a simulation and decision-support instrument. Its results depend on the inputs you provide and are stated as probability ranges, not as guaranteed outcomes. They do not replace your own professional judgement.

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence we are liable only for the breach of an essential contractual obligation, and then limited to the foreseeable damage typical for this type of contract. Any further liability is excluded.

6. Term and termination

This agreement runs for as long as you use the software. We may terminate it for cause if you seriously breach these terms; in that case you must stop using the software and delete the installed copies.

7. Applicable law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a merchant, the place of jurisdiction is Munich. Mandatory consumer protection provisions of your country of residence remain unaffected.
